Welcome to 99travellers.com (“Company,” “we,” “our,” or “us”). These Terms of Use (“Terms”) constitute a legally binding agreement between you and 99TRAVELLERS and govern your use of our website located at 99travellers.com (the “Site”).
By accessing, browsing, or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Site.
You represent that you are at least 18 years of age and have the legal authority and capacity to enter into these Terms.

Without limiting Section 1, you specifically agree that:

  • You will not use, allow, or authorize any artificial intelligence system, machine learning model, large language model (LLM), crawler, bot, spider, data-mining tool, or automated service (including but not limited to OpenAI, Perplexity, Groq, Anthropic, Gemini, or any competitor analytics tool) to access, scrape, copy, extract, or otherwise make use of any content, data, or material from the Site without our express written permission.
  • You will not use any content from 99TRAVELLERS.com to train, fine-tune, validate, or improve an AI system or competitive platform.
  • You will not reproduce our advertorials, comparison tables, coupon/deal listings, or affiliate strategies for commercial exploitation, whether by manual or automated means.
  • Competitors, market research firms, or analytics companies are strictly prohibited from copying or analyzing our content, methodology, pricing data, or affiliate structures without prior written agreement.

4. Penalty and Liquidated Damages

You acknowledge that unauthorized use of the Site — including scraping, crawling, AI ingestion, data mining, or competitor misuse — causes harm that is difficult to quantify.
Accordingly, you agree that:

  • Any violation of Sections 1–3 entitles 99TRAVELLERS to seek injunctive relief, damages, recovery of legal costs, and any other remedies available at law or equity.
  • In addition, you agree that damages for such violations  shall not be less than INR 5,00,000 (five lakh rupees) per violation, or the actual damages suffered by 99TRAVELLERS (including lost business, lost revenue, and reputational harm), whichever is greater.
  • This provision shall be enforceable under Section 74 of the Indian Contract Act, 1872, and you agree that it represents a fair, pre-estimated measure of damages.

5. Third-Party Links, Ads, and Content

The Site may include links to third-party sites, sponsored advertorials, affiliate offers, or advertisements.

  • These third-party sites are not under our control.
  • We are not responsible for their content, policies, or practices.
  • When you interact with third parties, their terms and privacy policies apply.

6. User Content

If you submit content (e.g., comments, reviews, suggestions), you grant 99TRAVELLERS a worldwide, royalty-free, perpetual, irrevocable license  to use, display, reproduce, and distribute it in connection with the Site.
You remain solely responsible for your submissions.

7. Cookies and Tracking

8. Disclaimer of Warranties

13. Dispute Resolution – Arbitration

Before initiating litigation, parties shall attempt to resolve disputes amicably. If unresolved, disputes may be referred to binding arbitration under the Arbitration and Conciliation Act, 1996 (India), conducted in English at [Your City], India.
Nothing in this section prevents 99TRAVELLERS from seeking injunctive or equitable relief in court for violations of Section 3 (AI Prohibited Use).

14. Electronic Communications

By using the Site, you consent to receive communications electronically (emails, notices, or postings on the Site). These satisfy any legal requirement for written communications.

15. General Provisions

  • These Terms constitute the entire agreement between you and 99TRAVELLERS.
  • If any provision is held unenforceable, the remaining provisions remain valid.
  • We may update these Terms periodically. Continued use of the Site indicates acceptance of changes.
  • You may not assign your rights under these Terms without our consent. We may assign our rights freely.
